A REVIEW AND CRITIQUE OF ADULT CRIMINAL JUSTICE PROCEDURES FROM ARREST TO SENTENCING, BASED ON DETAILED INTERVIEW WITH AND REPORTS FROM THE JUDICIARY, DEFENSE AND PROSECUTION PERSONNEL, AND LAW ENFORCEMENT PERSONNEL.
Abstract
IN ADDITION TO THE 39 REPORTS AND 44 INTERVIEWS CONSIDERED BY THE COMMISSION, EXTENSIVE DATA AND STATISTICS WERE UTILIZED TO DETERMINE THE PROCEDURES AND WORKLOAD OF THE CRIMINAL JUSTICE SYSTEM AS IT IS PRESENTLY CONSTITUTED AND FUNCTIONING. INCLUDED IN THE BODY OF THIS REPORT ARE AN OUTLINE OF PROCEDURES AND AGENCY FUNCTIONS FROM ARREST TO SENTENCING; A DISCUSSION OF COURT ORGANIZATION AND FACILITIES; A REVIEW OF ARREST AND CHARGING PROCEDURES; AND A DISCUSSION OF BAIL AND PRETRIAL RELEASE. CRIMINAL JUSTICE PROCEDURES AND RECOMMENDATIONS ON THESE PROCEDURES ARE THEN REVIEWED FOR MISDEMEANORS AND SUBURBAN COURTS, PROSECUTION OF FELONIES, PLEA BARGAINING, SENTENCING, HANDLING OF OF VICTIMLESS CRIMES, AND DIVERSIONARY PROGRAMS. THE FUNCTIONS OF THE STATE'S ATTORNEY, THE PUBLIC DEFENDER, AND THE ADULT PROBATION DEPARTMENT ARE CAREFULLY EXAMINED. PLANNING AND BUDGET NEEDS ARE EXPLORED AS WELL. A SUMMARY OF THE MAJOR RECOMMENDATIONS MADE FOR EACH OF THESE CRIMINAL JUSTICE FUNCTIONS IS PROVIDED.
