THE SCIENTIFIC DEVELOPMENT OF POLYGRAPHY HAS BEEN PARALLELED BY A CORRESPONDING GROWTH IN ITS USE BY GOVERNMENT, PRIVATE AND LAW ENFORCEMENT AGENCIES.
Abstract
THE ARTICLE STATES THAT IT IS TIME TO INVEST THE POLYGRAPH EXAMINATION WITH ITS APPROPRIATE STATURE. THE VALUE OF THE TECHNIQUE, WHEN USED IN A PROPER MANNER, WARRANTS JUDICIAL RECOGNITION. HOWEVER, THIS RECOMMENDATION FOR RECOGNITION DOES NOT IMPLY APPROVAL OF AN UNCONDITIONAL, OR UNREASONING ACCEPTANCE. THE ENDORSEMENT IS INTENDED STRICTLY FOR THE AREAS WHERE POLYGRAPH EXAMINATION HAS EXHIBITED A HIGH DEGREE OF REALIABILITY--AND ONLY FOR USE BY A COMPETENT, FULLY PROFESSIONAL, EXAMINER UNDER THE PROPER TEST CONDITIONS. THE EXAMINER, IN ALL CASES, MUST BE AVAILABLE FOR CROSSEXAMINATION AND COURT INQUIRY INTO THE TEST ENVIRONMENT, THE RELIABILITY ISSUE, AND HIS OWN PERSONAL QUALIFICATIONS. IN CRIMINAL CASES, THE DEFENDANT MUST BE ADVISED OF THE RIGHT TO COUNSEL AND THE RIGHT TO REMAIN SILENT.
