THEORIES OF JUSTICE, REASON AND ACCULTURATION ARE SUPPORTIVE OF A LEGAL PHILOSOPHER'S JUSTIFICATION OF THE LAW.
Abstract
THE PROCESS OF ESTABLISHING OR CREATING JUSTICE HAS BEEN PAINSTAKING. THIS WRITER PRESENTS HIS THEORY THAT THE DIRECT RELATIONSHIP BETWEEN A PUBLIC'S ASPIRATIONS AND THE CAPACITY TO CREATE JUST SYSTEMS IS VIABLE SO LONG AS THE PUBLIC'S DESIRES AND NOT INDIVIDUAL GRATIFICATION IS CONSIDERED. HERBERT MARCUSE'S AND JOHN STUART MILL'S ESSAYS ON CLOSELY RELATED SUBJECTS ARE COMPARED. ALSO INCLUDED ARE DISCUSSIONS OF LAW AND LOGIC, ENACTED LAW AS OPPOSED TO COMMON OR CUSTOMARY LAW, REASON AND SOCIOLOGY, AND THE CHINESE IMPERIAL CODE. ULTIMATELY THE AUTHOR TURNS TO JUSTICE TOWARD NATURE AND THE UNIFICATION OR RE-UNIFICATION OF MAN WITH NATURE.
