The Juvenile Justice and Delinquency Prevention Act (JJDPA) prohibits young people from being held in secure detention or confinement if they are charged with a status offense.
Common examples of status offenses include skipping school, running away from home, and missing curfew.
An exception continues to exist in the law known as the valid court order (VCO) exception.
Since its addition to the JJDPA in the 1980s, the VCO exception has caused thousands of young people to be incarcerated for status offense behaviors.
